These terms and conditions outline the rules and regulations for the use of Lusonode's Website.
"LUSONODE" provides web hosting services to customers worldwide. The following terms of service are designed to provide the highest level of service.
Accepting the terms
By accessing this website we assume you accept these terms and conditions in full. Do not continue to use Lusonode's website & services if you do not accept all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves.
All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of.
Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Prohibitions
"LUSONODE" will be the sole arbiter as to what constitutes a violation of this provision. Examples of prohibited use of the services of "LUSONODE" For the purpose of (but not limited to):
- Spamming, that is, sending unsolicited e-mail from any "LUSONODE" server or any server located on the "LUSONODE" network, is strictly prohibited. "LUSONODE" will be the sole arbiter as to what constitutes a violation of this provision. This also includes Opt-in Opt-out mail programs and mail that directly or indirectly refers to a domain contained in a "LUSONODE" account;
- Running Unconfirmed Mailing Lists. Subscribing to email addresses on any mailing list without the explicit and verifiable permission of the email address owner is prohibited. All mailing lists managed by clients of LUSONODE must be closed ("confirmed registration"). The subscription confirmation message received from each address owner must be kept on file for the duration of the mailing list. The purchase, sale, or use of third party email lists for mailing to any domain hosted on the "LUSONODE" website, or links to any "LUSONODE" domain account, is prohibited;
- Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this Agreement or the agreement of any other Internet Service Provider, including, but not limited to, facilitating a means of sending unsolicited bulk email, initiating pinging, flooding, mail spam, text spam, unsolicited bulk text messages or denial of service attacks, is prohibited;
- Cultivation of email addresses or any unauthorized collection of email addresses without prior notice to the owner of the email address is strictly prohibited;
- Account management on behalf of or in connection with the resale of any services to persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org is prohibited;
- All commercial email marketing companies must adhere to the Controlling Assault on Unsolicited Pornography and Marketing (CAN-SPAM);
- Act of 2003. In addition, such companies are prohibited from sending bulk mail from "disposable domain names" with whois privacy protection;
- Configuring your service to act as an open proxy server;
- Mining virtual currency (cryptocurrency) (Bitcoin, Etherium, etc.);
- The use of a tunnel or any other transport method to route traffic onto a backend infrastructure, with the intent of utilizing Lusonode DDoS-Protection services provided by another provider, is strictly prohibited for Cloud Servers without explicit consent from Lusonode. This restriction also applies to the resale of Lusonode DDoS-Protection services for services that are not designated as IP-Transit contracts with DDoS-Protection or Remote DDoS-Protection. Customers may request permission for such activities, subject to the terms of their contractual agreements.
Examples of prohibited actions in the infrastructure of "LUSONODE":
- Any attempt to undermine or harm LUSONODE's infrastructure or LUSONODE's customer is strictly prohibited, including but not limited to:
- Log in to a server or account that you are not authorized to access;
- Accessing data or taking any action to obtain services not intended for you or your use;
- Attempting to probe, scan, or test the vulnerability of any system, subsystem, or network without the owner's authorization;
- Tampering with, modifying or otherwise damaging or breaching security or authentication measures without proper authorization;
- Transmission of material containing viruses, Trojan horses, worms, time bombs, cancelbots or other computer programs or mechanisms with the intent or effect of damaging, destroying, disrupting or otherwise impairing computer functionality or system operation;
- Interference, interception or expropriation of any system, data or information;
- Interference with service to any user, host or network, including, but not limited to, overloading or "crashing" any computer system;
- Misuse of system resources, such as when using programs that consume excessive network capacity, CPU cycles or disk I/O. The exact limitations of the "LUSONODE" infrastructure are listed in the SLA and may vary depending on the type of service provided to the customer.
Examples of advertising and promotional restrictions for "LUSONODE" customers. (But not limited to them):
- Any illegal or unlawful activity;
- Any services designed to deceive, defraud, defame, coerce, or entice others to engage in illegal activities.
VPS Services
- The user independently manages and administers the VPS server, including servers with Windows operating system, as well as installs and modifies software at his/her discretion. If necessary, the user can contact the service provider to order VPS/Dedicated maintenance by submitting a corresponding request to the support service. The cost of such maintenance is determined individually between the parties. The service provider has the right to refuse to provide the service.
- When ordering a VPS/Dedicated with pre-installed Windows operating system, the user receives a service with a trial Windows license. Windows license activation is not the responsibility of the service provider.
- When using VPS, as well as dedicated servers with Microsoft Windows operating system, the service provider has the right to refuse to install, customize, update the software if the software distributions are not supported by Microsoft. The service provider is not responsible for failures in the operation of the software installed by the user and does not consider claims regarding technical failures.
- When providing Windows VPS service, as well as dedicated servers with Microsoft Windows operating system, the service provider is entitled to provide only 1 (one) RDP (Remote Desktop Protocol) terminal session to connect the user to a remote desktop for the purposes of testing, maintenance and administration of products.
- When using VPS, as well as dedicated servers, the user is recommended to use the system of ticket messages to solve technical issues. Technical support of users is provided by the service provider only through the specified messaging system.
- The user to whom the server/virtual server rental service is provided, confirms his/her consent and notification of the above conditions, as well as the absence of claims.
- VPS services in Germany are operating under a fair usage regime, meaning the network is shared among multiple clients on the same network.
- VPS services in Portugal and Brazil ,at the moment, are not eligible for upgrades.
- Any hands-on interventions (such as manual troubleshooting, custom configurations, OS recovery, or physical checks on dedicated servers) requested by the user may be subject to additional fees.
Backups
Customer agrees to maintain a current copy of all content hosted by LUSONODE, notwithstanding any agreement by LUSONODE to provide backup services.
Cookies
We employ the use of cookies. By using Lusonode's website you consent to the use of cookies in accordance with Lusonode's privacy policy.
Most of the modern day interactive web sites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.
License
Unless otherwise stated, Lusonode and/or it's licensors own the intellectual property rights for all material on Lusonode. All intellectual property rights are reserved. You may view and/or print pages from https://lusonode.com for your own personal use subject to restrictions set in these terms and conditions.
You must not:
- Republish material from lusonode;
- Sell, rent or sub-license material from lusonode;
- Reproduce, duplicate or copy material from lusonode;
- Redistribute content from Lusonode (unless content is specifically made for redistribution).
Hyperlinking to our Content
1) The following organizations may link to our Web site without prior written approval:
- Government agencies;
- Search engines;
- News organizations;
- Online directory distributors when they list us in the directory may link to our Web site in the same manner as they hyperlink to the Web sites of other listed businesses;
- Systemwide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.
2) These organizations may link to our home page, to publications or to other Web site information so long as the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site.
3) We may consider and approve in our sole discretion other link requests from the following types of organizations:
- commonly-known consumer and/or business information sources such as Chambers of Commerce, American Automobile Association, AARP and Consumers Union;
- dot.com community sites;
- associations or other groups representing charities, including charity giving sites;
- online directory distributors;
- internet portals;
- accounting, law and consulting firms whose primary clients are businesses;
- educational institutions and trade associations.
We will approve link requests from these organizations if we determine that: (a) the link would not reflect unfavorably on us or our accredited businesses (for example, trade associations or other organizations representing inherently suspect types of business, such as work-at-home opportunities, shall not be allowed to link); (b) the organization does not have an unsatisfactory record with us; (c) the benefit to us from the visibility associated with the hyperlink outweighs the absence of Lusonode; and (d) where the link is in the context of general resource information or is otherwise consistent with editorial content in a newsletter or similar product furthering the mission of the organization.
These organizations may link to our home page, to publications or to other Web site information so long as the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and it products or services; and (c) fits within the context of the linking party's site.

Please include your name, your organization name, contact information (such as a phone number and/or e-mail address) as well as the URL of your site, a list of any URLs from which you intend to link to our Web site, and a list of the URL(s) on our site to which you would like to link. Allow 2-3 weeks for a response.
Approved organizations may hyperlink to our Web site as follows:
- By use of our corporate name;
- By use of the uniform resource locator (Web address) being linked to;
- By use of any other description of our Web site or material being linked to that makes sense within the context and format of content on the linking party's site.
- No use of Lusonode's logo or other artwork will be allowed for linking absent a trademark license agreement.
Iframes
Without prior approval and express written permission, you may not create frames around our Web pages or use other techniques that alter in any way the visual presentation or appearance of our Web site.
Reservation of Rights
We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. You agree to immediately remove all links to our Web site upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to link to our Web site, you agree to be bound to and abide by these linking terms and conditions.
Removal of links from our website
If you find any link on our Web site or any linked web site objectionable for any reason, you may contact us about this. We will consider requests to remove links but will have no obligation to do so or to respond directly to you.
Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.
Content Liability
We shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website.
No link(s) may appear on any page on your Web site or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.
Refunds
- Lusonode maintains a 3-day refund policy, as long as there is a genuine technical problem with the server that takes more than 48 hours to resolve. The refund amount is equal to the amount of unused funds in the account minus the commission of payment systems for transferring funds and installation fee.
- Besides clause 1, In any situation, Lusonode provides a full or partial refund for our services. No refund will also be guaranteed in the event of abuse or breach of our terms of service and policies for using the service.
- Partial payments are not eligible for refund.
- Payments whith cryptocurrencies are not eligible for refund.
- Lusonode will not refund the value of any product that has been modified maliciously or negligently.
- When canceling a service with us, it is your responsibility to cancel any PayPal subscription linked to that service. Failure to do so will result in undue payments, which will be attributed to your credit balance. Overpayments are not refundable.
- It is also the customer's responsibility to cancel the service before the expiration date if he does not wish to be charged or charged for it. Any refund request must be made through a ticket submitted by the Client Area in the 'Payments Department' section, cancellation requests are not refund requests.
Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:
- limit or exclude our or your liability for death or personal injury resulting from negligence;
- limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
